Welcome to PaisaWay, a brand owned and operated by HariDream Solutions Private Limited. These Terms and Conditions ("Terms") govern your use of our loan marketplace platform, website, and services. By accessing or using PaisaWay, you agree to be bound by these Terms. Please read them carefully before using our services.

1. Definitions

• "Company" refers to HariDream Solutions Private Limited, the owner and operator of the PaisaWay brand
• "Platform" refers to the PaisaWay website, mobile application, and all related services
• "User" or "You" refers to any person who accesses or uses the Platform
• "Lender" refers to RBI-registered banks and NBFCs partnered with PaisaWay
• "Loan Products" refers to personal loans, business loans, home loans, and other financial products offered through the Platform
• "Services" refers to loan comparison, eligibility checking, application facilitation, and related services

2. Eligibility

To use our Platform, you must:

• Be at least 18 years of age
• Be a resident of India
• Have a valid PAN card and mobile number
• Have the legal capacity to enter into binding contracts
• Not be barred from accessing financial services under any applicable law

3. Nature of Services

3.1 Marketplace Platform

PaisaWay operates as a loan marketplace platform that connects borrowers with lenders. We are NOT a lender, bank, or NBFC. We do not provide loans directly. All loan products are offered and disbursed by our partner lenders who are RBI-registered financial institutions.

3.2 Our Role

We provide:

• Loan comparison and aggregation services
• Eligibility assessment tools
• Application facilitation services
• Document collection and verification assistance
• Communication between users and lenders

3.3 No Guarantee

We do not guarantee loan approval, specific interest rates, or loan disbursement. All lending decisions are made solely by the respective lenders based on their underwriting policies and your creditworthiness.

4. User Obligations

By using our Platform, you agree to:

• Provide accurate, complete, and current information
• Maintain the confidentiality of your account credentials
• Not share your OTPs, passwords, or PINs with anyone
• Not impersonate any person or entity
• Not use the Platform for any illegal or fraudulent purpose
• Not attempt to gain unauthorized access to our systems
• Not use automated scripts or bots to access the Platform
• Comply with all applicable laws and regulations

5. Loan Application Process

5.1 Application Submission

When you apply for a loan through our Platform, your application and personal information will be shared with relevant lenders for processing. You authorize us to share your information with lenders and credit bureaus.

5.2 Credit Bureau Consent

By using our eligibility check or applying for a loan, you consent to:

• Us accessing your credit report from authorized credit bureaus
• Lenders conducting their own credit checks
• Soft inquiries for eligibility assessment (which may not affect your credit score)
• Hard inquiries by lenders when processing your application (which may affect your credit score)

5.3 Lender's Terms

If your loan application is approved, you will enter into a separate loan agreement directly with the lender. The loan terms, including interest rate, tenure, EMI, processing fee, and other charges, will be governed by the lender's terms and conditions.

6. Fees and Charges

6.1 Platform Fees

Using PaisaWay's comparison and eligibility services is free for users. We may earn a referral fee or commission from lenders when a loan is successfully disbursed. This does not affect the loan terms offered to you.

6.2 Lender Fees

Lenders may charge processing fees, documentation charges, prepayment penalties, and other fees as per their policies. All applicable charges will be disclosed to you before loan disbursement.

7. Communication Consent

By registering on PaisaWay, you consent to receive:

• Service-related communications (application updates, loan status, etc.)
• Promotional communications about loan offers and financial products (if opted-in)
• Communications via SMS, email, phone calls, and WhatsApp

You may opt-out of promotional communications at any time by contacting us or using the unsubscribe option in our communications. Note: Service-related communications are essential and cannot be opted out while using our services.

8. Intellectual Property

All content on the Platform, including text, graphics, logos, icons, images, software, and trademarks, is the property of PaisaWay or its licensors and is protected by intellectual property laws. You may not copy, reproduce, modify, or distribute any content without our prior written consent.

9. Limitation of Liability

To the maximum extent permitted by law:

• PaisaWay shall not be liable for any loan decisions made by lenders
• We are not responsible for the terms, conditions, or actions of partner lenders
• We shall not be liable for any indirect, incidental, or consequential damages
• Our total liability shall not exceed the fees paid by you (if any) in the past 12 months
• We are not liable for any loss or damage arising from unauthorized access to your account due to your negligence

10. Indemnification

You agree to indemnify and hold harmless PaisaWay, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.

11. Termination

We may suspend or terminate your access to the Platform at any time, without prior notice, for any reason, including but not limited to:

• Violation of these Terms
• Providing false or misleading information
• Fraudulent activity or suspected fraud
• Non-compliance with applicable laws
• At our sole discretion

12. Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India.

12.2 Jurisdiction

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Rohtak, Haryana.

12.3 Arbitration

In the event of any dispute, the parties agree to first attempt resolution through good-faith negotiation. If unresolved within 30 days, the dispute shall be referred to arbitration under the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in English, in Rohtak, with a single arbitrator mutually agreed upon.

13. Modifications

We reserve the right to modify these Terms at any time. Material changes will be notified via email or prominent notice on the Platform. Your continued use of the Platform after such modifications constitutes acceptance of the updated Terms.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
